Six stones of Irish law

Ireland has no legal amount and no cannabis shops. What changes from one case to the next is how the Gardaí and the courts respond.

I

Illegal, any amount

Cannabis is a controlled drug. Possessing even a little is a criminal offence, for adults too, at home or in public.

II

First time: discretion

For a first possession for personal use, Gardaí can give an adult caution, and a health-led referral to the HSE is being introduced. Neither is automatic.

III

Fines, then prison

If you are convicted of possession for personal use, the first and second convictions bring a fine. From the third, prison becomes possible.

IV

Supply is serious

Selling, sharing or giving cannabis away counts as supply. Drugs worth €13,000 or more carry a presumptive minimum of 10 years.

V

Growing is an offence

Cultivating cannabis is a separate offence, even one plant for yourself, and several plants can point to supply.

VI

Roads and medicine

The driving limit is 1 ng/ml of THC, with at least a one-year ban. Medical cannabis exists only through a consultant, for a few conditions.

Help and harm reduction

  • Street cannabis can be laced with synthetic cannabinoids. Collapse, seizures or chest pain: call 112 or 999.
  • Edibles can take up to two hours to work. Never take a second dose because nothing seems to happen.
  • THC can stay above the driving limit long after the effect has gone. Take the bus, a taxi or walk.
  • If smoking weed is starting to cost you sleep, money or friends, talking about it early really helps.

Frequently asked questions

Is weed legal in Limerick?

No. Cannabis is a controlled drug in Ireland and possessing any amount is a criminal offence, in Limerick as everywhere else in the country.

Do I get a criminal record the first time?

Not always. For a first possession for personal use, Gardaí can give an adult caution or a health-led referral instead of going to court. It is their decision, not a right.

Has Ireland decriminalised cannabis?

No. The Citizens' Assembly on Drugs Use recommended a health-led approach, but possession is still a crime and selling is still treated as serious crime.

What is the driving limit for cannabis in Ireland?

1 ng of THC per ml of blood. Gardaí can test saliva at the roadside, and a conviction brings at least a one-year driving ban and a fine.

Can I get medical cannabis in Ireland?

Only through a consultant, under the Medical Cannabis Access Programme, for a few conditions such as MS spasticity, severe epilepsy and nausea from chemotherapy.
